Section 60I Certificate

Types of section 60I certificates

There are five types of certificates a FDR practitioner may issued:

  1. Refusal or failure to attend – issued in circumstances when a party refuses or fails to attend FDR without adequate reason.
  2. FDR considered not appropriate – issued in circumstances where the FDR practitioner deems it not appropriate for the parties to attend FDR.
  3. Parties attended FDR and genuine effort made – issued to the parties when both parties attended FDR, made a genuine attempt to reach an agreement however an agreement was not made.
  4. Parties attended FDR but no genuine effort made – issued when both parties attended FDR however one or more party did not make a genuine effort to reach an agreement.
  5. Parties attended FDR but not appropriate to continue – issued when parties commence FDR but it is not appropriate to continue.

It is the decision of the FDR practitioner to issue a section 60I certificate and which type of certificate.
Section 60I certificates are valid for 12 months from the time the last FDR was attended or attempted.
